Harassment vs Bullying
Harassment is unwelcome conduct, which is either severe or pervasive, and based upon an employee’s protected class.
An employee is protected from harassment by:
- Any employee, regardless of position;
- A volunteer or intern; and/or
- A third party (vendor, customer, etc.)
Harassment vs Bullying
Although bullying is unwelcome conduct which can be severe or pervasive, bullying is not based on an employee’s protected class.
For example:
- A supervisor treats all employees poorly, regardless of their race, religion, gender, etc.
- A coworker ridicules an employee on a daily basis because of the kind of car they drive.
Bullying is not against the law, per NH RSA 354-A; however, an employer is recommended to have a comprehensive policy to prevent and prohibit bullying in the workplace.
