It is unlawful to discharge, expel, or otherwise retaliate or discriminate against any person for opposing practices forbidden by NH RSA 354-A

What is Retaliation?

Retaliation is an adverse action taken against a person because they:

  • Asserted their rights
  • Opposed a discriminatory practice
  • Filed a discrimination complaint
  • Participated in an investigation
  • Requested an accommodation

Examples of Retaliation

  • Unwarranted disciplinary action
  • Termination, suspension or layoff
  • Reduction in hours
  • Harassment
  • Demotion
  • Unwarranted changes in job duties/responsibilities

What to do if Subjected to Retaliation

  1. Submit a complaint with your employer; and/or
  2. Contact the Commission; and/or
  3. Submit a complaint with the Commission

Retaliation can occur outside of an employment setting. Examples of retaliatory adverse actions that are non-work related include:

  • Disparaging the person to others or in the media;
  • Making false reports to government authorities;
  • Filing a civil action; and
  • Making threats of deportation, or initiating other action with immigration authorities.
