Familial Status

It is against the law to discriminate against an individual due to the presence, or anticipated presence of, children under the age of 18.

Protected Individuals Include: 

  • Parents, grandparents or other persons with legal custody of a child;
  • Pregnant women;
  • Adoptive parents;
  • Those fostering a child;
  • The designee of such parent or other person having such custody, with the written permission of such parent or other person; and
  • Persons in the process of securing legal custody.

A landlord does not have the right to decide how many children share a room or what constitutes a bedroom, aside from a kitchen or bathroom. Additionally, a landlord does not have the right to decide the gender of the children sharing a room. 

Important to Note: You cannot be discriminated against due to the number of children in your household. A landlord would have the burden of demonstrating the home’s septic or well capacity to rule out discrimination.
