Housing Laws

Anyone who is engaged in the transaction of buying or renting a residential or commercial property is protected from discrimination.

Protected Activities Include: 

  • Buying, selling or renting;
  • Terms, conditions or privileges of the sale or rental;
  • Advertising or statements made in connection with the sale or rental;
  • Financing; and
  • Provisions of real estate sales, brokerage or appraisal services.

Additionally, the following actions are a violation of state law:

  • Coercion, intimidation or threatening a person who attempts to exercise their rights under state discrimination law; 
  • Retaliation against anyone who opposes discrimination or files a claim with the Commission or assists in an investigation/proceeding at the Commission; and
  • Aiding and abetting another person to engage in discrimination.

Exemptions

  • Owner occupied buildings with no more than three units, if the owner lives in one of the units, per federal law; 
  • Owner occupied buildings with no more than four units, if the owner lives in one of the units, per state law;
  • Single family homes, if the owner does not own more than one such single family home and if the owner does not utilize a rental agent; 
  • Rentals of rooms in a housing accommodation with not more than 5 such rooms; and
  • Limited exemptions for religious organizations, private clubs and nonprofit organizations.
