No person shall be excluded from participation in, denied the benefits of, or be subjected to discrimination in public schools because of their age, sex, gender identity, sexual orientation, race, color, marital status, familial status, disability, religion or national origin.

For schools subject to NH RSA 354-A, protection against discrimination extends to:

  • Extracurricular activities

Schools exempt from NH RSA 354-A

  • Colleges 
  • Universities
  • Private primary schools
  • Private secondary schools
  • Montessori schools
  • Boarding schools
  • Parochial schools
Private primary schools and public or private schools of higher education are overseen by the NH Department of Education, Office of Civil Rights or the U.S. Department of Education.
